TERMS OF USE

Free for noncommercial use. US$199 once for commercial use up to 10,000 daily users. Above that, contact us for a separate agreement.

Effective for Clair 0.5.0 and later releases supplied under these terms.

1. Scope
“Clair” means the original Clair style code, generated style JSON, original
icons, sprites and documentation supplied under this license. Third-party
software, fonts and map data are excluded and retain their own licenses.
Rights in earlier copies lawfully received under another license are unchanged.

2. Free noncommercial license
You may use, copy and modify Clair without payment for purposes that are not
primarily intended for commercial advantage or monetary compensation. Personal
projects, education and noncommercial research qualify. Business websites,
paid client work, advertising-supported products and services used to operate
or promote a business require a commercial license, even when free to users.
Nonprofit status alone does not determine whether a use is commercial.

3. Standard commercial license — US$199, one payment
After payment of the commercial license fee through the authorized Clair
checkout, the person or legal entity identified by the purchase receipt may
use, copy and modify Clair in an unlimited number of its commercial projects,
provided their combined audience does not exceed 10,000 daily users.
This license is worldwide, non-exclusive, perpetual, and has no renewal fee.
It covers Clair releases obtained under these terms, including later updates
made available under this license. No future updates are promised.
Employees and contractors may use Clair on the licensee's behalf. Client
projects may be delivered with Clair embedded for use in those projects; the
client receives the right to operate and maintain those delivered projects,
not to extract Clair for use in unrelated projects. Affiliates that are
separate legal entities need their own license for their own projects.

Daily users means the number of distinct people who view or interact with a
Clair map during a calendar day (UTC), across all projects covered by the
license, including delivered client projects. Count a person once per day
across those projects where reasonably measurable; otherwise sum each project's
daily unique users. Exclude identifiable bots and automated monitoring.
Page views, tile requests and visitors who do not use a Clair map are not users
for this threshold. Use reasonable, privacy-respecting audience estimates;
this license does not require identifying people or installing tracking software.

3a. Commercial use above 10,000 daily users — separate agreement
Commercial use exceeding the standard license's daily-user limit requires a
separate written commercial agreement with Clair's licensor. Contact us through
the Clair website before exceeding the limit to agree scope and pricing.
The US$199 license alone does not authorize use above the limit. Paying that
fee or requesting a quote does not grant the additional rights. The standard
license remains perpetual for use within its scope. Unless the separate
agreement states otherwise, the other conditions of this license still apply.
The daily-user limit applies to commercial use, not to qualifying free
noncommercial use under section 2.

4. Distribution and restrictions
Under the applicable grant, you may distribute Clair as necessary to operate and
deliver permitted maps and applications, including serving style JSON and
assets to their users. You may self-host and retain copies for permitted use.
Preserve this license and copyright notice in distributed source or asset
bundles, and retain the supplied third-party notices and map attribution.
You may not resell, sublicense or distribute Clair as a standalone style,
asset library or competing style-distribution service. A commercial license
is not transferable separately from an agreed transfer of the licensed
business. No rights to the Clair name or trademarks are granted except to
identify the style. Other rights are reserved.

5. Hosting and third-party services
The license fee purchases permission to use Clair, not map data, a service
subscription, technical support or guaranteed availability of hosted APIs,
CDNs or future releases. Third-party services may have separate fees and
terms. The perpetual license survives discontinuation of Clair's hosting.

6. Termination
A material breach terminates the affected license if it is not remedied within
30 days after written notice. On termination, stop the uses authorized by the
terminated grant. Rights that cannot lawfully be terminated are unaffected.

7. Warranty and liability
To the extent permitted by applicable law, Clair is provided “as is”, without
warranties of accuracy, fitness, merchantability or noninfringement. To the
extent permitted by applicable law, the licensor is not liable for indirect,
incidental or consequential losses arising from use of Clair. Nothing in
these terms excludes rights or liabilities that cannot lawfully be excluded,
including applicable mandatory consumer rights.
